A Manhattan judge was forced to declare a mistrial for the second time Thursday when a Manhattan jury deadlocked on the top count against Ashanti's creepy stalker, Devar Hurd, who represented himself — again.
After two days of deliberation, the jury could not reach a unanimous decision on whether Hurd, 36, was guilty of felony stalking.
At his first trial last year, a different judge was forced to declare a mistrial after a juror got sick during deliberations.
But this time around the panel did convict him of 9 counts of misdemeanor criminal contempt, stalking and harassment for sending hundreds of sexually explicit tweets to the Grammy-winning singer and posing for a picture with her little sister in violation of a restraining order.
Ashanti Douglas, 34, had to take the stand again Oct. 1 and endure her deranged admirer giddily question her about the vulgar tweets.
She told jurors in Manhattan Supreme Court that she felt "disgusted, disrespected" and "scared" by the graphic messages.
Prosecutor Carolina Holderness told Justice Roger Hayes that she intended to retry Hurd on the felony stalking charge, which could mean that Ashanti will have to take the stand a third time.
Hurd asked the judge to release him without bail. He has been held since his arrest over two years ago on $750,000 bond. He faces a maximum of two years, which he's already served, when he's sentenced Oct. 23.
"They haven't proven their case beyond a reasonable doubt, and clearly there's no reason why I wouldn't come to court," he told the judge.
Hayes denied the request.
This wasn't Hurd's first run-in with authorities over his obsession with the R&B crooner.
He was convicted of stalking and harassment in 2009 for sending crotch-shots to Ashanti's mom in a twisted bid to get close to the singer.
