It's been a rough last few days for Halle Berry and Olivier Martinez.

And it's going to get even rougher, as E! News has learned the Cloud Atlas star will appear in a Los Angeles court Tuesday to request an emergency restraining order against her ex Gabriel Aubry.

Beforehand, however, Berry and her French actor fiancé looked pretty darn glum and exhausted as they arrived at their Beverly Hills home today with the 46-year-old actress's 4-year-old daughter, Nahla. The public outing comes four days after Martinez got into a nasty scuffle with Berry's baby daddy that sent both men to the hospital and landed the latter a misdemeanor battery charge.

Lets hope things start looking up for the twosome real soon!
